Netflix Show Highlights Violent Crime’s Real Impact
Netflix’s recent four-part series Adolescence has been a huge hit in the UK. It has sparked discussions around the lasting effects of violent crime on young people and the wider community. The series highlights real-life experiences of victims and their families, addressing the challenges they face.
The impact of violent crime goes far beyond physical injuries. Victims often face emotional trauma, financial burdens, and a long road to recovery. If you or someone you know has been affected by violent crime, seeking compensation can provide much-needed support during this difficult time.
We understand these struggles and are here to help victims of violent crime access the compensation they deserve.
What is criminal injuries compensation?
In the UK, victims of violent crime may be eligible for compensation through the Criminal Injuries Compensation Authority (CICA), a government-run scheme designed to provide financial support to those who have suffered physical or psychological harm due to a crime of violence. This includes incidents such as assault, sexual abuse, domestic violence, and other serious offences.
The CICA scheme operates on a set of rules that determine eligibility and the amount of compensation awarded. However, the process can be complex, and many victims are unsure how to navigate the system or whether they even qualify. The Association of Personal Injury Lawyers (APIL) recently called for changes to the scheme. It believes more must be done to ensure that victims are informed about their rights and the support available to them.
Who can claim compensation through the CICA?
To be eligible for compensation through the CICA, you must meet certain criteria:
- The crime must have taken place in England, Scotland, or Wales (Northern Ireland has a separate scheme)
- The incident must be reported to the police as soon as reasonably possible
- The application must be submitted within two years of the incident (exceptions may apply for historical abuse cases or if the victim was unable to apply sooner due to exceptional circumstances)
- The victim must have suffered physical or psychological injuries as a result of the crime
You must have been one of the following when the violent crime happened:
- A British citizen or EU or EEA national (or their close relative)
- A family member of an EU or EEA national who has the right to be in the UK
- A member of the armed forces (or you’re a close relative living in their household)
- A potential victim of human trafficking on or before the date of your application – this must be confirmed by the UK Human Trafficking Centre and UK Visas and Immigration
- An asylum seeker
- A national of a country that has signed up to the Council of Europe Convention on the Compensation of Victim of Violent Crimes
You’re also eligible if you were ‘ordinarily resident’ in the UK at the time of the crime. This depends on your connection to the UK, for example if you were living, working or studying there (or you were the family member of someone who was).
How much compensation can violent crime victims receive?
The amount of compensation awarded through the CICA varies depending on the severity of the injuries sustained. The minimum payout is £1,000, while the maximum award can go up to £500,000 in the most serious cases. The scheme covers:
- Physical injuries (such as broken bones, scarring, or life-changing injuries)
- Psychological trauma (such as PTSD, anxiety, or depression diagnosed by a medical professional)
- Loss of earnings if the victim is unable to work due to the injuries
- Special expenses, such as medical treatment, care costs, and adaptations to housing for those with long-term disabilities
Challenges in claiming compensation
Although the CICA scheme exists to support victims, many find the application process daunting. Common challenges include:
- Delays in processing claims: CICA applications can take months, sometimes years, to be reviewed
- Insufficient evidence: Victims must provide medical records, police reports, and other supporting documents to prove their claim
- Application rejections: Some claims are denied due to minor discrepancies, late reporting of the crime, or a lack of sufficient evidence
There is a significant lack of awareness about the compensation scheme. Every year, around 480,000 people in Great Britain are injured due to violent crime. Yet, in the 2022/23 financial year, only 36,686 applications were made to the CICA, just 8% of all victims.
This suggests that many victims are simply unaware that they could claim compensation. We play a vital role in bridging this gap, helping clients understand their entitlements and guiding them through the claims process.
We help victims prepare and submit their claims correctly, ensuring they have the best chance of securing compensation. If a claim is rejected, we can also assist with appeals and reconsiderations to fight for the justice our clients deserve.
