A successful trial last week for our client, a motorcyclist, who had been knocked off his bike by a car pulling a trailer as they overtook him in slow-moving traffic.
The defendant denied liability throughout seeking to argue that they did not make contact with our client whom they alleged simply lost control of his bike and fell off.
The defendant sought to rely on an independent witness but they failed to attend the trial and his evidence was discredited in his absence.
The defendant also adduced his dashcam evidence which the Judge agreed showed him suddenly applying his brakes – a sign that he had felt a collision.
Before the trial, we had made a sensible and realistic settlement offer of £5,000 which was ignored by the defendant.
At trial, we “beat” our own offer meaning the defendant had to pay punitive interest and costs. A fantastic result for our client.
