£2,000 settlement secured after restaurant slip on wet stairs

A slip or fall in a restaurant can happen in seconds, but the consequences can leave you dealing with an injury and the frustration of trying to get the compensation you deserve.

We recently helped a client who slipped on wet stairs in a well-known restaurant. What initially appeared to be a straightforward personal injury claim became more complicated when the restaurant’s insurers denied liability. Their reason for rejecting the claim was that there was no accident record to support what had happened.

However, the absence of an accident report did not mean our client’s account of the incident should be dismissed. Importantly, our client had been assisted by a member of the restaurant staff following the fall. There was also a witness who had seen the accident happen.

These details were important in challenging the insurer’s position. Just because an accident has not been formally recorded does not mean it did not happen or that there is no evidence to support a claim. Rather than accepting the insurer’s decision, we challenged the denial of liability and took the matter further by issuing court proceedings.

Our efforts were successful, and we secured a £2,000 settlement for our client.

This case highlights why it is important not to give up if an insurer initially rejects your personal injury claim. The absence of an accident report does not automatically mean you have no case, particularly when there may be other evidence or witnesses to support what happened.

It also demonstrates that you do not have to suffer a life-changing injury to have a legitimate claim. An injury that you recover from within a few weeks can still have an impact on your life and deserves to be taken seriously.

If you’ve been injured in a slip, trip or fall because of someone else’s negligence, don’t assume you have no grounds for a claim.
